Privacy Policy
This Privacy Policy governs the processing of personal data by the company INTELEK LTD, branch office, Ericha Roučky 1291/4, Brno, CZ, registered in the Commercial Register maintained by the Regional Court in Brno (hereinafter referred to as “INTELEK” or “the Company”) in connection with the use of the iGET FIT mobile application (hereinafter referred to as the “Application”).

INTELEK respects your right to privacy. Whether you use our mobile applications, visit our website, or communicate with us electronically in any other way, we will always take all necessary measures and do our utmost to secure your personal data. Our processing of personal data will always be in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the “General Data Protection Regulation” or “GDPR”) and in accordance with Act No. 101/2000 Coll., on the Protection of Personal Data and on Amendments to Certain Acts, as amended (hereinafter referred to as the “ZOOÚ”).

INTELEK undertakes to store all personal data collected from individuals who use our application and utilize our online facilities and services in an accurate, confidential, and secure manner, solely to the extent, for the purposes, and for the duration specified below. The principles of this processing are also set forth in this document.

What personal data we store about you:
INTELEK processes your personal data only on the basis of a legal or contractual authorization, consent provided, or a legitimate interest. INTELEK will always use the personal data you provide only to the extent listed below:

- login credentials (email address and password),
- address data (country/region),
- gender,
- date of birth,
- height and weight data,
- information related to your athletic performance and daily routine (e.g., number of steps, heart rate and blood pressure, sleep patterns and duration, calories burned, walking, cycling, swimming, etc.),
- information about your specific device (such as hardware model, operating system version, unique device identifiers, and mobile network information, including phone number). INTELEK may associate your device identifiers with your account.

When you use our services or browse content provided by INTELEK, we automatically collect and store certain information in server logs. This includes:

- details about how you used our service,
- information related to your athletic performance and daily routine (such as step count, heart rate and blood pressure, sleep patterns and duration, calories burned, walking, cycling, swimming, etc.).

When using the iGET FIT app, we may collect and store information (including personal data) locally on your device in the app’s cache.

How we process your data while using the iGET FIT app:
After launching the app and connecting your wearable device, you will be prompted to log in to the app using an existing user account or to create a new one. When creating a user account, you will be asked to choose a username, which also serves as the email address required for sending information related to the app, as well as a login password and region. The username and password you choose, along with the region, are stored on the company’s secure cloud server located in the Czech Republic, with backups in Frankfurt am Main, Germany.

After creating a user account, you will be asked to provide information necessary for the proper functioning of the application and the provision of its features. This includes your gender, height, weight, and date of birth. The data provided in this manner will not be made available to us and will remain stored only on your device unless you provide consent for its transfer to the company. Other personal data is stored only in the device’s memory, and the company does not process this data and does not have access to it.
If you choose to do so, your personal data may be backed up to the company’s secure cloud storage located in the Czech Republic. However, this data will not be further processed by the company unless you provide your consent.

If you decide to grant the company consent to process your data, specifically your gender, height, weight, and date of birth, the company will be authorized to use this data anonymously for its own purposes, particularly for the purpose of evaluating it and comparing it with other users. We may subsequently display this anonymous evaluation to you in the app. If you do not grant this consent, this data will be stored only in the device’s memory and on the company’s secure cloud storage located in the Czech Republic, with backups in Frankfurt am Main, Germany, and the company will not have access to it.

What are the legal grounds for processing your personal data:
The company processes your login credentials (email address and password) along with your address data because they are necessary for the proper functioning of the app, i.e., to fulfill contractual obligations.

If you decide to give the company consent to process additional data about you, specifically your gender, height, weight, date of birth, and information related to your athletic performance and daily routine (such as step count, heart rate and blood pressure, sleep patterns and duration, calories burned, walking, cycling, swimming, etc.), this personal data will be processed based on the consent you have provided.

Based on the company’s legitimate interest or your consent, we may also send you news about the services you use with us. For example, if you register in the iGET FIT mobile app, we will send you news related to the iGET FIT app. However, you can unsubscribe from newsletters and other marketing communications (or adjust the scope) at any time via the link in each message we send.

For what purposes do we process your personal data:
The company processes your login credentials for purposes necessary to fulfill contractual or legal obligations. We also store your personal data in cloud storage for backup purposes.

If you grant your consent, the company will be authorized to use the personal data you provide in an anonymous manner for its own purposes as well, particularly for the purposes of evaluation and comparison with other users of the app; we may subsequently display this anonymous evaluation to you within the app.

From time to time, we may offer you the opportunity to participate in contests, advertising campaigns, and other promotional events. All information provided in connection with these activities will be processed in accordance with this Privacy Policy. From time to time, we may also ask you to participate in surveys that help us improve the app. Any personal data provided in connection with any survey will be used solely for that survey and will not be shared with third parties not bound by this Privacy Policy.

Based on the company’s legitimate interest, the company is also authorized to process your email address for the purpose of sending marketing communications.

To Whom We Disclose Your Personal Data:
Your personal data will be processed by the Company. The Company will process personal data both manually and automatically, either directly or through its employees.

The Company may transfer your personal data to other processors for the purposes mentioned above so that they may process it on the Company’s behalf. These processors are:

- the operator of the Satomar cloud storage service, s.r.o., ID No.: 29201586, with its registered office at Šimáčkova 247/31, Líšeň, 628 00 Brno.

We reserve the right to transfer all of your personal data in our possession to a successor organization in the event of a merger, acquisition, bankruptcy, or other sale of all or part of our assets. You acknowledge that any such transfers may occur and that the successor organization or other acquirer may refuse to fulfill the obligations arising from this Privacy Policy.

Data Retention Period:
We retain your personal data only for as long as is necessary for the purpose for which we collected it. Typically, this will be for the duration of our service provision to you or for the period required by law for its retention. If we have your data because you voluntarily consented to it, we will process it for the duration of your consent, unless you revoke your consent earlier.

For direct marketing purposes, personal data will be processed for a period of 5 years following the termination of service provision.

How Your Personal Data Is Secured:
Your personal data is under our constant physical, electronic, and procedural control. We use modern control, technical, and security mechanisms to secure it, so that we can provide your data with the maximum possible protection against unauthorized access or transfer, against its loss or destruction, and against other possible misuse.

Everyone who comes into contact with your personal data in the course of fulfilling their work or contractual obligations is bound by a strict legal and/or contractual duty of confidentiality, which remains in effect even after the termination of their employment or contractual relationship with us. We regularly monitor compliance with these obligations, including security requirements, both internally and among our suppliers, to ensure you have the utmost confidence that your data is well protected.

Please keep in mind, however, that even the best security measures cannot completely eliminate all risks. Any data published online is susceptible to theft and misuse by unauthorized third parties. We cannot guarantee that only authorized persons will view your personal data. We assume no liability if a third party circumvents any privacy settings or security measures.

Your Rights
In relation to our processing of your personal data, you have the following rights:

- the right of access to personal data;
- the right to rectification;
- the right to erasure (“right to be forgotten”);
- the right to restrict processing;
- the right to object to processing;
- the right to lodge a complaint regarding the processing of personal data.

Your rights are explained below so that you can gain a clearer understanding of their scope.

The right of access means that you may at any time request confirmation from us as to whether personal data concerning you is being processed, and if so, for what purposes, to what extent, to whom it is disclosed, how long we will process it, whether you have the right to rectification, erasure, restriction of processing, or to object; where we obtained the personal data; and whether automated decision-making, including profiling, occurs based on the processing of your personal data. You also have the right to obtain a copy of your personal data, with the first provision being free of charge; for subsequent provisions, the Controller may request reasonable reimbursement of administrative costs.

The right to rectification means that you may ask us at any time to correct or complete your personal data if it is inaccurate or incomplete.

The right to erasure means that we must erase your personal data if

- it is no longer necessary for the purposes for which it was collected or otherwise processed,
- the processing is unlawful,
- you object to the processing and there are no overriding legitimate grounds for the processing, or
- we are required to do so by law.

The right to restriction of processing means that until we resolve any disputed issues regarding the processing of your personal data, we must restrict the processing of your personal data so that we may only store it and, if necessary, use it for the purpose of establishing, exercising, or defending legal claims.

The right to object means that you may object to the processing of your personal data that we process for direct marketing purposes or on the basis of a legitimate interest. If you object to processing for direct marketing purposes, your personal data will no longer be processed for those purposes.

Changes to the Privacy Policy:
INTELEK reserves the right to update and/or modify the terms of our Privacy Policy, and as such, we will post these changes on the homepage of our website at www.iget.eu so that users and/or visitors always know what type of information we collect, how it will be handled, and under what circumstances, if any, we may disclose this information. If at any time we decide to maintain any personally identifiable information in a manner significantly different from that stated at the time of collection, the user or users will be immediately notified via email. Users will then have the option to decide whether or not to allow their data to be used in this different manner.

You may file a complaint with the supervisory authority, which is the Office for Personal Data Protection (www.uoou.cz).

This Privacy Policy becomes valid and effective on August 1, 2018.
